These Terms of Service govern the use of the messaging application PHANTOM (the "App" or "Service"), provided by:

By installing and using the App, you agree to these Terms.
PHANTOM is an end-to-end encrypted messenger with post-quantum cryptography. The Service includes:
Using PHANTOM does not require any personal data. Your account is identified by a cryptographically generated anonymous ID and protected by a passphrase you choose.
You are solely responsible for safekeeping your passphrase. If you lose your passphrase, we cannot restore access to your account — the encryption makes this technically impossible.
PHANTOM is free to use. Messaging and group chats are unlimited without payment, and Stories are free to watch — as are post-quantum encryption, Sealed Sender, self-destructing messages, and blockchain key transparency. There is no trial that expires, and no advertising.
"PHANTOM Pro" is an optional one-time purchase and is not required to use the messenger. It permanently unlocks what costs us bandwidth and storage: sending photos, videos and voice messages, and posting your own Stories.
The Pro subscriptions offered in earlier versions are no longer sold. Existing subscriptions keep their Pro features until cancelled.
There is nothing to cancel on a one-time purchase. A Pro subscription taken out in an earlier version can be cancelled at any time through your Apple account settings (Settings → Apple ID → Subscriptions). The messenger itself stays free to use either way.
You agree not to use the App for the following purposes:
Due to end-to-end encryption, we have no access to your message contents. However, we provide a reporting function that allows users to flag problematic content. Reported content is verified through a cryptographic franking mechanism without us seeing the message contents.
Our liability is limited to intentional misconduct and gross negligence. For slight negligence, we are only liable for breaches of material contractual obligations, limited to foreseeable, contract-typical damages.
We strive for high availability of the Service but cannot guarantee it. Maintenance, technical issues, or force majeure may cause temporary outages.
PHANTOM employs state-of-the-art encryption technologies including post-quantum cryptography. Nevertheless, we cannot provide an absolute security guarantee. Use of the App is at your own risk.
PHANTOM is open-source software. The source code is published under the respective open-source licenses. The "PHANTOM" trademark and associated branding are protected and may not be used commercially without permission.

PHANTOM offers features for irrevocable data deletion (disappearing messages, Dead Man's Switch, Blockchain Kill Switch, account deletion). Use of these features is at your own responsibility. Deleted data cannot be recovered.
We reserve the right to amend these Terms. Material changes will be communicated through the App or our website. Continued use of the App after changes constitutes acceptance.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive venue for disputes is, to the extent permitted by law, the registered office of AI&Workflow Solutions UG.
If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.
